十七部門印發《關于健全支持中小企業發展制度的若干意見》

各省、自治區(qu)、直轄市及計劃單(dan)列市人民政府(fu),新疆(jiang)生(sheng)產建設(she)兵團:

中小企(qi)(qi)業(ye)是(shi)國(guo)民經濟和社(she)會發(fa)展(zhan)(zhan)的(de)(de)(de)主力軍,是(shi)建設現代化(hua)經濟體系、推動(dong)經濟高(gao)質量發(fa)展(zhan)(zhan)的(de)(de)(de)重要基(ji)礎(chu),是(shi)擴大就(jiu)業(ye)、改善(shan)民生(sheng)的(de)(de)(de)重要支撐,是(shi)企(qi)(qi)業(ye)家精(jing)神的(de)(de)(de)重要發(fa)源(yuan)地。黨中央(yang)、國(guo)務院(yuan)高(gao)度重視中小企(qi)(qi)業(ye)發(fa)展(zhan)(zhan),近(jin)年來出(chu)臺了一(yi)系列政策措施,有關(guan)工作取得積極成(cheng)(cheng)效,但(dan)仍存在(zai)一(yi)些(xie)突出(chu)問題,特別是(shi)一(yi)些(xie)基(ji)礎(chu)性制度性問題亟待解決。為深入貫徹黨的(de)(de)(de)十九屆四中全會精(jing)神,堅(jian)持(chi)和完善(shan)社(she)會主義基(ji)本經濟制度,堅(jian)持(chi)“兩(liang)個(ge)毫不動(dong)搖”,形成(cheng)(cheng)支持(chi)中小企(qi)(qi)業(ye)發(fa)展(zhan)(zhan)的(de)(de)(de)常態化(hua)、長效化(hua)機(ji)制,促進中小企(qi)(qi)業(ye)高(gao)質量發(fa)展(zhan)(zhan),經國(guo)務院(yuan)同意,現就(jiu)健(jian)全支持(chi)中小企(qi)(qi)業(ye)發(fa)展(zhan)(zhan)制度,提(ti)出(chu)如(ru)下意見。

一、完善支持中小企業發展的基礎性制度

(一)健(jian)全中小(xiao)企(qi)(qi)業(ye)(ye)法(fa)(fa)(fa)(fa)律法(fa)(fa)(fa)(fa)規(gui)(gui)體系。以《中小(xiao)企(qi)(qi)業(ye)(ye)促進法(fa)(fa)(fa)(fa)》為基礎(chu),加快構建具有中國特色、支持(chi)中小(xiao)企(qi)(qi)業(ye)(ye)發展(zhan)、保護中小(xiao)企(qi)(qi)業(ye)(ye)合法(fa)(fa)(fa)(fa)權益的法(fa)(fa)(fa)(fa)律法(fa)(fa)(fa)(fa)規(gui)(gui)體系。鼓(gu)勵地方依法(fa)(fa)(fa)(fa)制定本地促進中小(xiao)企(qi)(qi)業(ye)(ye)發展(zhan)的地方法(fa)(fa)(fa)(fa)規(gui)(gui)。探索建立中小(xiao)企(qi)(qi)業(ye)(ye)法(fa)(fa)(fa)(fa)律法(fa)(fa)(fa)(fa)規(gui)(gui)評(ping)估制度(du)(du)和執行(xing)情(qing)況檢查制度(du)(du),督促法(fa)(fa)(fa)(fa)律法(fa)(fa)(fa)(fa)規(gui)(gui)落實(shi)到(dao)位。

(二(er))堅持(chi)公(gong)(gong)(gong)平(ping)競爭(zheng)制(zhi)度。全面實施市場(chang)準(zhun)入負(fu)面清單(dan)制(zhi)度,公(gong)(gong)(gong)正公(gong)(gong)(gong)平(ping)對待中小企(qi)業(ye)(ye),破除不(bu)合理(li)門檻和限制(zhi),實現大中小企(qi)業(ye)(ye)和各種(zhong)所有制(zhi)經(jing)濟權利(li)平(ping)等、機會(hui)平(ping)等、規則(ze)平(ping)等。全面落實公(gong)(gong)(gong)平(ping)競爭(zheng)審(shen)查(cha)制(zhi)度,完善(shan)審(shen)查(cha)流(liu)程和標(biao)準(zhun),建(jian)立健全公(gong)(gong)(gong)平(ping)競爭(zheng)審(shen)查(cha)投訴、公(gong)(gong)(gong)示、抽查(cha)制(zhi)度。加強和改進反(fan)壟(long)斷和反(fan)不(bu)正當(dang)競爭(zheng)執法,維護市場(chang)競爭(zheng)秩序。

(三)完(wan)善中(zhong)(zhong)(zhong)小(xiao)(xiao)(xiao)(xiao)(xiao)企(qi)業(ye)(ye)統(tong)計(ji)監(jian)測(ce)和(he)發(fa)布制(zhi)度。健全中(zhong)(zhong)(zhong)小(xiao)(xiao)(xiao)(xiao)(xiao)企(qi)業(ye)(ye)統(tong)計(ji)監(jian)測(ce)制(zhi)度,定(ding)期發(fa)布中(zhong)(zhong)(zhong)小(xiao)(xiao)(xiao)(xiao)(xiao)企(qi)業(ye)(ye)統(tong)計(ji)數(shu)據。建立中(zhong)(zhong)(zhong)小(xiao)(xiao)(xiao)(xiao)(xiao)企(qi)業(ye)(ye)融資狀況調查統(tong)計(ji)制(zhi)度,編制(zhi)中(zhong)(zhong)(zhong)小(xiao)(xiao)(xiao)(xiao)(xiao)微企(qi)業(ye)(ye)金融條件指數(shu)。加(jia)強中(zhong)(zhong)(zhong)小(xiao)(xiao)(xiao)(xiao)(xiao)企(qi)業(ye)(ye)結構化分(fen)析,提高統(tong)計(ji)監(jian)測(ce)分(fen)析水平。探索利用大數(shu)據等手段開展中(zhong)(zhong)(zhong)小(xiao)(xiao)(xiao)(xiao)(xiao)企(qi)業(ye)(ye)運(yun)行監(jian)測(ce)分(fen)析。完(wan)善《中(zhong)(zhong)(zhong)小(xiao)(xiao)(xiao)(xiao)(xiao)企(qi)業(ye)(ye)主要(yao)統(tong)計(ji)數(shu)據》手冊(ce),研究編制(zhi)中(zhong)(zhong)(zhong)小(xiao)(xiao)(xiao)(xiao)(xiao)企(qi)業(ye)(ye)發(fa)展指數(shu)。適時(shi)修(xiu)訂中(zhong)(zhong)(zhong)小(xiao)(xiao)(xiao)(xiao)(xiao)企(qi)業(ye)(ye)劃(hua)型標(biao)準。

(四)健(jian)全(quan)中(zhong)小(xiao)企(qi)業(ye)(ye)信(xin)用制度。堅持“政府+市場”的模式,建立健(jian)全(quan)中(zhong)小(xiao)企(qi)業(ye)(ye)信(xin)用信(xin)息(xi)歸(gui)集、共(gong)享、查詢(xun)機制,依托全(quan)國(guo)信(xin)用信(xin)息(xi)共(gong)享平臺(tai),及(ji)時整合(he)共(gong)享各類涉企(qi)公共(gong)服(fu)務(wu)數據(ju)。建立健(jian)全(quan)中(zhong)小(xiao)企(qi)業(ye)(ye)信(xin)用評價體(ti)系(xi),完善金融(rong)(rong)信(xin)用信(xin)息(xi)基(ji)礎數據(ju)庫,創(chuang)新小(xiao)微企(qi)業(ye)(ye)征信(xin)產品,高(gao)效對(dui)接金融(rong)(rong)服(fu)務(wu)。研究出臺(tai)有關(guan)法(fa)(fa)(fa)律法(fa)(fa)(fa)規,規范中(zhong)小(xiao)企(qi)業(ye)(ye)信(xin)用信(xin)息(xi)采集、公示查詢(xun)和(he)信(xin)用監管等。發(fa)揮國(guo)家企(qi)業(ye)(ye)信(xin)用信(xin)息(xi)公示系(xi)統的基(ji)礎作用,將涉企(qi)信(xin)息(xi)記于企(qi)業(ye)(ye)名(ming)下并依法(fa)(fa)(fa)公示。

(五)完善公(gong)正監(jian)管(guan)制(zhi)度。減少監(jian)管(guan)事項(xiang),簡化(hua)辦(ban)事流程(cheng),推(tui)(tui)廣全程(cheng)網上辦(ban)、引導幫辦(ban),全面(mian)推(tui)(tui)行(xing)信(xin)用監(jian)管(guan)和“互聯網+監(jian)管(guan)”改革。推(tui)(tui)進分級(ji)分類、跨部門聯合監(jian)管(guan),加(jia)強和規范事中事后監(jian)管(guan),落實和完善包容審慎監(jian)管(guan),避(bi)免對(dui)中小企業采取(qu)簡單粗暴處(chu)理(li)措施,對(dui)“一刀切”行(xing)為嚴肅(su)查處(chu)。

       二、堅持和完善中小企業財稅支持制度

(六)健全精(jing)準(zhun)有(you)效的(de)財(cai)政(zheng)支(zhi)持制(zhi)度。中(zhong)央財(cai)政(zheng)設立(li)(li)中(zhong)小(xiao)(xiao)企(qi)(qi)業科目,縣級以上(shang)財(cai)政(zheng)根據(ju)實際情況安排中(zhong)小(xiao)(xiao)企(qi)(qi)業發展專(zhuan)(zhuan)項(xiang)資金(jin)(jin)。建立(li)(li)國家中(zhong)小(xiao)(xiao)企(qi)(qi)業發展基金(jin)(jin)公司制(zhi)母(mu)基金(jin)(jin),健全基金(jin)(jin)管理(li)制(zhi)度,完善基金(jin)(jin)市場化(hua)運作機制(zhi),引導有(you)條(tiao)件的(de)地方政(zheng)府設立(li)(li)中(zhong)小(xiao)(xiao)企(qi)(qi)業發展基金(jin)(jin)。完善專(zhuan)(zhuan)項(xiang)資金(jin)(jin)管理(li)辦法,加強(qiang)資金(jin)(jin)績效評價。

(七(qi))建立減(jian)輕小微企(qi)(qi)(qi)業稅(shui)(shui)費(fei)負擔長效機制。實(shi)行(xing)有(you)利于小微企(qi)(qi)(qi)業發展的(de)稅(shui)(shui)收(shou)(shou)政(zheng)策(ce)(ce),依法對符合(he)條件的(de)小微企(qi)(qi)(qi)業按照規(gui)定實(shi)行(xing)緩征(zheng)(zheng)(zheng)、減(jian)征(zheng)(zheng)(zheng)、免征(zheng)(zheng)(zheng)企(qi)(qi)(qi)業所得稅(shui)(shui)、增值稅(shui)(shui)等措施,簡化稅(shui)(shui)收(shou)(shou)征(zheng)(zheng)(zheng)管程序;對小微企(qi)(qi)(qi)業行(xing)政(zheng)事業性收(shou)(shou)費(fei)實(shi)行(xing)減(jian)免等優惠政(zheng)策(ce)(ce),減(jian)輕小微企(qi)(qi)(qi)業稅(shui)(shui)費(fei)負擔。落(luo)實(shi)好涉(she)企(qi)(qi)(qi)收(shou)(shou)費(fei)目錄清(qing)單制度,加(jia)強涉(she)企(qi)(qi)(qi)收(shou)(shou)費(fei)監督檢(jian)查,清(qing)理規(gui)范涉(she)企(qi)(qi)(qi)收(shou)(shou)費(fei)。

(八)強化政(zheng)府(fu)(fu)(fu)采(cai)購支持(chi)中小(xiao)企(qi)(qi)(qi)業(ye)(ye)政(zheng)策機(ji)制。修訂《政(zheng)府(fu)(fu)(fu)采(cai)購促進中小(xiao)企(qi)(qi)(qi)業(ye)(ye)發展暫行辦法》,完善預留采(cai)購份額、價格評(ping)審優惠(hui)等(deng)措施,提高中小(xiao)企(qi)(qi)(qi)業(ye)(ye)在政(zheng)府(fu)(fu)(fu)采(cai)購中的份額。向中小(xiao)企(qi)(qi)(qi)業(ye)(ye)預留采(cai)購份額應占本部門(men)年度政(zheng)府(fu)(fu)(fu)采(cai)購項(xiang)目預算(suan)總額的30%以(yi)上(shang);其中,預留給小(xiao)微企(qi)(qi)(qi)業(ye)(ye)的比例不低于60%。

三、堅持和完善中小企業融資促進制度

(九)優(you)化貨(huo)幣信貸(dai)傳導機制(zhi)。綜(zong)合運用支小再貸(dai)款(kuan)、再貼現、差別存(cun)款(kuan)準備金(jin)率(lv)等貨(huo)幣政策工具,引導商業銀行增加小微企業信貸(dai)投放。進一(yi)步疏(shu)通利(li)(li)率(lv)傳導渠(qu)道,確保(bao)貸(dai)款(kuan)市(shi)場報價利(li)(li)率(lv)(LPR)有效傳導至貸(dai)款(kuan)利(li)(li)率(lv)。建立差異(yi)化小微企業利(li)(li)率(lv)定價機制(zhi),促進信貸(dai)利(li)(li)率(lv)和費用公開透明,保(bao)持小微企業貸(dai)款(kuan)利(li)(li)率(lv)定價合理(li)水平。

(十)健全多層次(ci)小(xiao)微(wei)企(qi)(qi)(qi)業(ye)金(jin)(jin)(jin)融(rong)(rong)服(fu)(fu)務體系(xi)。推(tui)進普惠金(jin)(jin)(jin)融(rong)(rong)體系(xi)建設(she),深化大中(zhong)型銀(yin)行(xing)普惠金(jin)(jin)(jin)融(rong)(rong)事業(ye)部(bu)改(gai)革,推(tui)動中(zhong)小(xiao)銀(yin)行(xing)、非存款(kuan)(kuan)(kuan)類金(jin)(jin)(jin)融(rong)(rong)機(ji)(ji)構(gou)和互聯網金(jin)(jin)(jin)融(rong)(rong)有序健康(kang)發(fa)展(zhan)(zhan)。鼓勵金(jin)(jin)(jin)融(rong)(rong)機(ji)(ji)構(gou)創(chuang)新產品和服(fu)(fu)務,發(fa)展(zhan)(zhan)便利續(xu)貸(dai)業(ye)務和信用貸(dai)款(kuan)(kuan)(kuan),增加(jia)小(xiao)微(wei)企(qi)(qi)(qi)業(ye)首貸(dai)、中(zhong)長期貸(dai)款(kuan)(kuan)(kuan)、知識(shi)產權質押貸(dai)款(kuan)(kuan)(kuan)等,開展(zhan)(zhan)供應鏈金(jin)(jin)(jin)融(rong)(rong)、應收(shou)賬款(kuan)(kuan)(kuan)融(rong)(rong)資,加(jia)強銀(yin)稅(shui)互動。推(tui)動金(jin)(jin)(jin)融(rong)(rong)科技賦能金(jin)(jin)(jin)融(rong)(rong)機(ji)(ji)構(gou)服(fu)(fu)務中(zhong)小(xiao)企(qi)(qi)(qi)業(ye)。研究出臺《非存款(kuan)(kuan)(kuan)類放貸(dai)組(zu)織條(tiao)例(li)》。加(jia)快推(tui)進小(xiao)額金(jin)(jin)(jin)融(rong)(rong)糾紛快速解決等機(ji)(ji)制(zhi)(zhi)建設(she)。完善規范銀(yin)行(xing)業(ye)涉企(qi)(qi)(qi)服(fu)(fu)務收(shou)費監管法規制(zhi)(zhi)度(du),降低小(xiao)微(wei)企(qi)(qi)(qi)業(ye)綜合性融(rong)(rong)資成本。

(十一)強化小微(wei)企(qi)業(ye)金融(rong)(rong)差異化監(jian)管(guan)激勵機(ji)(ji)制(zhi)。健全商業(ye)銀(yin)行(xing)小微(wei)企(qi)業(ye)金融(rong)(rong)服(fu)務(wu)(wu)監(jian)管(guan)長(chang)效機(ji)(ji)制(zhi),出臺《商業(ye)銀(yin)行(xing)小微(wei)企(qi)業(ye)金融(rong)(rong)服(fu)務(wu)(wu)監(jian)管(guan)評(ping)(ping)價辦(ban)法》。修訂《金融(rong)(rong)企(qi)業(ye)績效評(ping)(ping)價辦(ban)法》。將商業(ye)銀(yin)行(xing)小微(wei)企(qi)業(ye)服(fu)務(wu)(wu)情況(kuang)與資(zi)本(ben)補充、金融(rong)(rong)債發行(xing)、宏觀審慎評(ping)(ping)估(MPA)考(kao)核(he)、金融(rong)(rong)機(ji)(ji)構(gou)總部相關(guan)負(fu)責人(ren)考(kao)核(he)及提任掛鉤。引導(dao)銀(yin)行(xing)業(ye)金融(rong)(rong)機(ji)(ji)構(gou)探索(suo)建立授(shou)信(xin)(xin)盡職免責負(fu)面(mian)清單制(zhi)度。督促商業(ye)銀(yin)行(xing)優化內部信(xin)(xin)貸(dai)資(zi)源配置和考(kao)核(he)激勵機(ji)(ji)制(zhi),單列(lie)小微(wei)企(qi)業(ye)信(xin)(xin)貸(dai)計劃,改(gai)進(jin)貸(dai)款服(fu)務(wu)(wu)方式。

(十二)完善(shan)中(zhong)(zhong)小(xiao)企(qi)業(ye)(ye)直(zhi)接(jie)融(rong)資(zi)支持制(zhi)(zhi)度。大力(li)培(pei)育創(chuang)(chuang)業(ye)(ye)投(tou)(tou)資(zi)市場(chang)(chang),完善(shan)創(chuang)(chuang)業(ye)(ye)投(tou)(tou)資(zi)激(ji)勵(li)和退出(chu)機(ji)(ji)制(zhi)(zhi),引導天(tian)使投(tou)(tou)資(zi)人群體、私募股(gu)權(quan)、創(chuang)(chuang)業(ye)(ye)投(tou)(tou)資(zi)等擴大中(zhong)(zhong)小(xiao)企(qi)業(ye)(ye)股(gu)權(quan)融(rong)資(zi),更多地投(tou)(tou)長、投(tou)(tou)早、投(tou)(tou)小(xiao)、投(tou)(tou)創(chuang)(chuang)新(xin)(xin)。穩(wen)步(bu)推進以信息(xi)披露為核心的(de)注冊制(zhi)(zhi)改革(ge),支持更多優(you)質(zhi)中(zhong)(zhong)小(xiao)企(qi)業(ye)(ye)登陸資(zi)yabo官网場(chang)(chang)。鼓勵(li)中(zhong)(zhong)小(xiao)企(qi)業(ye)(ye)通過并(bing)購重組對接(jie)資(zi)yabo官网場(chang)(chang)。穩(wen)步(bu)推進新(xin)(xin)三板改革(ge),健全掛牌公司(si)轉板上市機(ji)(ji)制(zhi)(zhi)。完善(shan)中(zhong)(zhong)小(xiao)企(qi)業(ye)(ye)上市培(pei)育機(ji)(ji)制(zhi)(zhi),鼓勵(li)地方加大對小(xiao)升規、規改股(gu)、股(gu)上市企(qi)業(ye)(ye)的(de)支持。加大優(you)質(zhi)中(zhong)(zhong)小(xiao)企(qi)業(ye)(ye)債券融(rong)資(zi),通過市場(chang)(chang)化機(ji)(ji)制(zhi)(zhi)開發更多適(shi)合中(zhong)(zhong)小(xiao)企(qi)業(ye)(ye)的(de)債券品種(zhong),完善(shan)中(zhong)(zhong)小(xiao)企(qi)業(ye)(ye)債券融(rong)資(zi)增信機(ji)(ji)制(zhi)(zhi),擴大債券融(rong)資(zi)規模。

(十三)完善中小(xiao)企業(ye)(ye)(ye)融(rong)(rong)資(zi)(zi)擔(dan)保(bao)體系。健全(quan)政(zheng)府性融(rong)(rong)資(zi)(zi)擔(dan)保(bao)體系,發揮國家融(rong)(rong)資(zi)(zi)擔(dan)保(bao)基金(jin)作(zuo)用,實(shi)施小(xiao)微企業(ye)(ye)(ye)融(rong)(rong)資(zi)(zi)擔(dan)保(bao)降費(fei)獎補(bu)政(zheng)策,完善風險(xian)補(bu)償機(ji)(ji)制(zhi)和績效考核激勵機(ji)(ji)制(zhi),引導各級(ji)政(zheng)府性融(rong)(rong)資(zi)(zi)擔(dan)保(bao)機(ji)(ji)構(gou)擴大(da)小(xiao)微企業(ye)(ye)(ye)融(rong)(rong)資(zi)(zi)擔(dan)保(bao)業(ye)(ye)(ye)務(wu)規模(mo)、降低擔(dan)保(bao)費(fei)率水平。鼓勵銀行業(ye)(ye)(ye)金(jin)融(rong)(rong)機(ji)(ji)構(gou)加大(da)與政(zheng)府性融(rong)(rong)資(zi)(zi)擔(dan)保(bao)機(ji)(ji)構(gou)合(he)作(zuo),合(he)理確定風險(xian)分(fen)擔(dan)比(bi)例(li)和擔(dan)保(bao)貸款風險(xian)權重,落實(shi)金(jin)融(rong)(rong)機(ji)(ji)構(gou)和融(rong)(rong)資(zi)(zi)擔(dan)保(bao)機(ji)(ji)構(gou)盡(jin)職(zhi)免責(ze)制(zhi)度,提(ti)高小(xiao)微企業(ye)(ye)(ye)融(rong)(rong)資(zi)(zi)可(ke)獲得性。推動建立統(tong)一的動產(chan)和權利(li)擔(dan)保(bao)登記公示系統(tong)。

四、建立和健全中小企業創新發展制度

(十四)完(wan)(wan)善(shan)創業(ye)扶持制度。改善(shan)創業(ye)環境,廣泛培育創業(ye)主體(ti)。完(wan)(wan)善(shan)創業(ye)載體(ti)建設,健全扶持與評價機制,為小(xiao)微企(qi)業(ye)創業(ye)提(ti)供(gong)低成(cheng)本、便利化(hua)、高質量服務(wu)(wu)。鼓勵(li)大企(qi)業(ye)發揮技術優(you)(you)勢、人才優(you)(you)勢和市場優(you)(you)勢,為創業(ye)活動(dong)提(ti)供(gong)支撐。鼓勵(li)服務(wu)(wu)機構提(ti)供(gong)創業(ye)相關規范化(hua)、專(zhuan)業(ye)化(hua)服務(wu)(wu)。

(十五)完善(shan)(shan)中(zhong)(zhong)小(xiao)(xiao)企(qi)(qi)業(ye)(ye)(ye)(ye)創(chuang)(chuang)(chuang)(chuang)(chuang)新(xin)(xin)(xin)(xin)支持制(zhi)度(du)。創(chuang)(chuang)(chuang)(chuang)(chuang)新(xin)(xin)(xin)(xin)中(zhong)(zhong)小(xiao)(xiao)企(qi)(qi)業(ye)(ye)(ye)(ye)產學(xue)研(yan)深度(du)融合(he)機制(zhi),促進大(da)(da)中(zhong)(zhong)小(xiao)(xiao)企(qi)(qi)業(ye)(ye)(ye)(ye)聯(lian)合(he)參(can)與重大(da)(da)科(ke)技(ji)項目,推(tui)動高(gao)校、科(ke)研(yan)院所和(he)(he)大(da)(da)企(qi)(qi)業(ye)(ye)(ye)(ye)科(ke)研(yan)儀器(qi)、實驗設施、中(zhong)(zhong)試小(xiao)(xiao)試基(ji)地等創(chuang)(chuang)(chuang)(chuang)(chuang)新(xin)(xin)(xin)(xin)資源向中(zhong)(zhong)小(xiao)(xiao)企(qi)(qi)業(ye)(ye)(ye)(ye)開放。調整完善(shan)(shan)科(ke)技(ji)計劃立項、任務部署和(he)(he)組織管理方式,大(da)(da)幅提高(gao)中(zhong)(zhong)小(xiao)(xiao)企(qi)(qi)業(ye)(ye)(ye)(ye)承擔研(yan)發任務比例,加大(da)(da)對中(zhong)(zhong)小(xiao)(xiao)企(qi)(qi)業(ye)(ye)(ye)(ye)研(yan)發活(huo)動的直接(jie)支持。完善(shan)(shan)專業(ye)(ye)(ye)(ye)化市(shi)場化創(chuang)(chuang)(chuang)(chuang)(chuang)新(xin)(xin)(xin)(xin)服務體系,完善(shan)(shan)國家技(ji)術(shu)創(chuang)(chuang)(chuang)(chuang)(chuang)新(xin)(xin)(xin)(xin)中(zhong)(zhong)心(xin)、制(zhi)造業(ye)(ye)(ye)(ye)創(chuang)(chuang)(chuang)(chuang)(chuang)新(xin)(xin)(xin)(xin)中(zhong)(zhong)心(xin)等支持中(zhong)(zhong)小(xiao)(xiao)企(qi)(qi)業(ye)(ye)(ye)(ye)創(chuang)(chuang)(chuang)(chuang)(chuang)新(xin)(xin)(xin)(xin)的機制(zhi),提升小(xiao)(xiao)微企(qi)(qi)業(ye)(ye)(ye)(ye)創(chuang)(chuang)(chuang)(chuang)(chuang)業(ye)(ye)(ye)(ye)創(chuang)(chuang)(chuang)(chuang)(chuang)新(xin)(xin)(xin)(xin)示范(fan)基(ji)地、科(ke)技(ji)企(qi)(qi)業(ye)(ye)(ye)(ye)孵化器(qi)、專業(ye)(ye)(ye)(ye)化眾(zhong)創(chuang)(chuang)(chuang)(chuang)(chuang)空(kong)間、大(da)(da)學(xue)科(ke)技(ji)園等扶持中(zhong)(zhong)小(xiao)(xiao)企(qi)(qi)業(ye)(ye)(ye)(ye)創(chuang)(chuang)(chuang)(chuang)(chuang)新(xin)(xin)(xin)(xin)的能力(li)與水(shui)平。完善(shan)(shan)中(zhong)(zhong)小(xiao)(xiao)企(qi)(qi)業(ye)(ye)(ye)(ye)創(chuang)(chuang)(chuang)(chuang)(chuang)新(xin)(xin)(xin)(xin)人才(cai)引進和(he)(he)培育制(zhi)度(du),優化人才(cai)激勵(li)(li)和(he)(he)權益(yi)保障機制(zhi)。以(yi)包容審(shen)慎的態度(du),鼓勵(li)(li)中(zhong)(zhong)小(xiao)(xiao)企(qi)(qi)業(ye)(ye)(ye)(ye)技(ji)術(shu)創(chuang)(chuang)(chuang)(chuang)(chuang)新(xin)(xin)(xin)(xin)、產品(pin)創(chuang)(chuang)(chuang)(chuang)(chuang)新(xin)(xin)(xin)(xin)、模(mo)式創(chuang)(chuang)(chuang)(chuang)(chuang)新(xin)(xin)(xin)(xin)。

(十六)完善支持中(zhong)(zhong)(zhong)小(xiao)企(qi)業(ye)(ye)(ye)“專精(jing)特新”發展機制(zhi)。健全“專精(jing)特新”中(zhong)(zhong)(zhong)小(xiao)企(qi)業(ye)(ye)(ye)、專精(jing)特新“小(xiao)巨人(ren)”企(qi)業(ye)(ye)(ye)和制(zhi)造業(ye)(ye)(ye)單項(xiang)冠軍(jun)企(qi)業(ye)(ye)(ye)梯(ti)度(du)培育(yu)體(ti)系(xi)、標(biao)準體(ti)系(xi)和評價機制(zhi),引(yin)導中(zhong)(zhong)(zhong)小(xiao)企(qi)業(ye)(ye)(ye)走(zou)“專精(jing)特新”之路。完善大(da)中(zhong)(zhong)(zhong)小(xiao)企(qi)業(ye)(ye)(ye)和各(ge)類主體(ti)協同(tong)創(chuang)新和融通發展制(zhi)度(du),發揮大(da)企(qi)業(ye)(ye)(ye)引(yin)領(ling)支撐作用,提高中(zhong)(zhong)(zhong)小(xiao)企(qi)業(ye)(ye)(ye)專業(ye)(ye)(ye)化(hua)能力和水平(ping)。

(十(shi)七)構建以信息技(ji)術(shu)(shu)(shu)為(wei)主的(de)(de)新(xin)技(ji)術(shu)(shu)(shu)應(ying)用(yong)機(ji)制。支持中(zhong)小(xiao)企(qi)業(ye)(ye)發展應(ying)用(yong)5G、工業(ye)(ye)互聯網、大數(shu)據、云計算、人工智(zhi)(zhi)能(neng)(neng)(neng)、區塊鏈等新(xin)一(yi)代信息技(ji)術(shu)(shu)(shu)以及新(xin)材料技(ji)術(shu)(shu)(shu)、智(zhi)(zhi)能(neng)(neng)(neng)綠(lv)色服務制造技(ji)術(shu)(shu)(shu)、先進高效(xiao)生物技(ji)術(shu)(shu)(shu)等,完(wan)善(shan)支持中(zhong)小(xiao)企(qi)業(ye)(ye)應(ying)用(yong)新(xin)技(ji)術(shu)(shu)(shu)的(de)(de)工作機(ji)制,提(ti)升(sheng)中(zhong)小(xiao)企(qi)業(ye)(ye)數(shu)字化(hua)、網絡化(hua)、智(zhi)(zhi)能(neng)(neng)(neng)化(hua)、綠(lv)色化(hua)水平。支持產(chan)業(ye)(ye)園(yuan)區、產(chan)業(ye)(ye)集群(qun)提(ti)高基礎設施支撐能(neng)(neng)(neng)力,建立中(zhong)小(xiao)企(qi)業(ye)(ye)新(xin)技(ji)術(shu)(shu)(shu)公共(gong)服務平臺,完(wan)善(shan)新(xin)技(ji)術(shu)(shu)(shu)推(tui)廣機(ji)制,提(ti)高新(xin)技(ji)術(shu)(shu)(shu)在園(yuan)區和產(chan)業(ye)(ye)鏈上的(de)(de)整體應(ying)用(yong)水平。

五、完善和優化中小企業服務體系

(十八(ba))完善(shan)中小(xiao)企業(ye)(ye)服(fu)(fu)(fu)務(wu)(wu)(wu)體系。健全政府公(gong)(gong)共服(fu)(fu)(fu)務(wu)(wu)(wu)、市場化(hua)服(fu)(fu)(fu)務(wu)(wu)(wu)、社會化(hua)公(gong)(gong)益(yi)服(fu)(fu)(fu)務(wu)(wu)(wu)相結(jie)合(he)的中小(xiao)企業(ye)(ye)服(fu)(fu)(fu)務(wu)(wu)(wu)體系,完善(shan)服(fu)(fu)(fu)務(wu)(wu)(wu)機(ji)構良性發(fa)展機(ji)制和(he)公(gong)(gong)共服(fu)(fu)(fu)務(wu)(wu)(wu)平(ping)臺梯度培育、協同服(fu)(fu)(fu)務(wu)(wu)(wu)和(he)評(ping)價激勵(li)機(ji)制。探索建立全國中小(xiao)企業(ye)(ye)公(gong)(gong)共服(fu)(fu)(fu)務(wu)(wu)(wu)一體化(hua)平(ping)臺。發(fa)展中小(xiao)企業(ye)(ye)服(fu)(fu)(fu)務(wu)(wu)(wu)產業(ye)(ye),引(yin)導服(fu)(fu)(fu)務(wu)(wu)(wu)機(ji)構提供規(gui)范化(hua)、精細化(hua)、個性化(hua)服(fu)(fu)(fu)務(wu)(wu)(wu),引(yin)導大企業(ye)(ye)結(jie)合(he)產業(ye)(ye)鏈、供應鏈、價值鏈、創新(xin)鏈為中小(xiao)企業(ye)(ye)提供配套(tao)服(fu)(fu)(fu)務(wu)(wu)(wu)。鼓勵(li)各類(lei)社會組織(zhi)為企業(ye)(ye)提供公(gong)(gong)益(yi)性服(fu)(fu)(fu)務(wu)(wu)(wu),探索建立志(zhi)愿服(fu)(fu)(fu)務(wu)(wu)(wu)機(ji)制。

(十九(jiu))健(jian)全促進中(zhong)小(xiao)(xiao)企(qi)(qi)業管(guan)理提升機制(zhi)。完(wan)(wan)善(shan)中(zhong)小(xiao)(xiao)企(qi)(qi)業培訓制(zhi)度(du),構建具有(you)時(shi)代特點的(de)(de)課程、教材、師資和組織體系(xi),建設慕(mu)課平臺,構建多領(ling)域、多層次(ci)、線上線下相結合的(de)(de)中(zhong)小(xiao)(xiao)企(qi)(qi)業培訓體系(xi)。健(jian)全技能(neng)(neng)人(ren)才(cai)培養、使用、評價、激勵(li)制(zhi)度(du),加快培養高(gao)素質(zhi)技能(neng)(neng)人(ren)才(cai),弘(hong)揚“工(gong)匠(jiang)精神”。健(jian)全中(zhong)小(xiao)(xiao)企(qi)(qi)業品牌(pai)培育機制(zhi)。實施小(xiao)(xiao)微企(qi)(qi)業質(zhi)量(liang)管(guan)理提升行動。完(wan)(wan)善(shan)中(zhong)小(xiao)(xiao)企(qi)(qi)業管(guan)理咨詢服務(wu)機制(zhi)。

(二十)夯(hang)實(shi)(shi)中(zhong)小(xiao)(xiao)(xiao)企(qi)業國際交流合作機制(zhi)。深化雙多(duo)邊中(zhong)小(xiao)(xiao)(xiao)企(qi)業合作機制(zhi),促進中(zhong)小(xiao)(xiao)(xiao)企(qi)業國際交流合作。探(tan)索(suo)建設中(zhong)小(xiao)(xiao)(xiao)企(qi)業海外服務體系,夯(hang)實(shi)(shi)中(zhong)小(xiao)(xiao)(xiao)企(qi)業國際化發展服務機制(zhi),在(zai)國際商(shang)務法(fa)務咨詢、知識產(chan)權保(bao)護、技術性貿易措施、質量認證等方面為中(zhong)小(xiao)(xiao)(xiao)企(qi)業提供幫助(zhu)。支(zhi)持有條件(jian)的地方建設中(zhong)外中(zhong)小(xiao)(xiao)(xiao)企(qi)業合作區,完善評(ping)價(jia)激勵機制(zhi)。推進關稅保(bao)證保(bao)險(xian)改(gai)革。鼓勵跨(kua)境電(dian)商(shang)等新業態發展,探(tan)索(suo)建立B2B出(chu)口監管制(zhi)度,支(zhi)持跨(kua)境電(dian)商(shang)優進優出(chu)。

六、建立和健全中小企業合法權益保護制度

(二十一(yi))構建保護中小(xiao)(xiao)(xiao)企(qi)(qi)(qi)(qi)業(ye)(ye)及企(qi)(qi)(qi)(qi)業(ye)(ye)家合法財(cai)產(chan)(chan)權制度。堅決保護中小(xiao)(xiao)(xiao)企(qi)(qi)(qi)(qi)業(ye)(ye)及企(qi)(qi)(qi)(qi)業(ye)(ye)家合法財(cai)產(chan)(chan)權,依(yi)法懲治侵犯中小(xiao)(xiao)(xiao)企(qi)(qi)(qi)(qi)業(ye)(ye)投資者、管理者和從(cong)業(ye)(ye)人(ren)(ren)員(yuan)合法權益的違法犯罪行為。嚴(yan)格(ge)(ge)按照(zhao)法定程序采(cai)取查封(feng)、扣(kou)押(ya)、凍結(jie)等(deng)措施,依(yi)法嚴(yan)格(ge)(ge)區分違法所得、其他涉案(an)財(cai)產(chan)(chan)與合法財(cai)產(chan)(chan),嚴(yan)格(ge)(ge)區分企(qi)(qi)(qi)(qi)業(ye)(ye)法人(ren)(ren)財(cai)產(chan)(chan)與股(gu)東個(ge)人(ren)(ren)財(cai)產(chan)(chan),嚴(yan)格(ge)(ge)區分涉案(an)人(ren)(ren)員(yuan)個(ge)人(ren)(ren)財(cai)產(chan)(chan)與家庭成員(yuan)財(cai)產(chan)(chan)。建立涉政府產(chan)(chan)權糾(jiu)紛治理長(chang)效機(ji)制。出臺并落(luo)實《保障中小(xiao)(xiao)(xiao)企(qi)(qi)(qi)(qi)業(ye)(ye)款項支付條(tiao)例》,從(cong)源頭遏制拖欠(qian)問(wen)題。

(二(er)十二(er))健全中(zhong)(zhong)小企(qi)(qi)(qi)業(ye)(ye)(ye)知(zhi)識(shi)(shi)(shi)(shi)產(chan)(chan)權(quan)(quan)保護(hu)(hu)(hu)制度。完善(shan)知(zhi)識(shi)(shi)(shi)(shi)產(chan)(chan)權(quan)(quan)保護(hu)(hu)(hu)法律法規和(he)(he)政策,建(jian)立健全懲罰性賠償制度,提(ti)(ti)高(gao)(gao)法定賠償額。實施中(zhong)(zhong)小企(qi)(qi)(qi)業(ye)(ye)(ye)知(zhi)識(shi)(shi)(shi)(shi)產(chan)(chan)權(quan)(quan)戰(zhan)略推(tui)進工程(cheng),加強(qiang)知(zhi)識(shi)(shi)(shi)(shi)產(chan)(chan)權(quan)(quan)服務業(ye)(ye)(ye)集聚發(fa)展(zhan)區建(jian)設(she)(she),強(qiang)化專利導航工作機制,完善(shan)支持中(zhong)(zhong)小企(qi)(qi)(qi)業(ye)(ye)(ye)開發(fa)自主知(zhi)識(shi)(shi)(shi)(shi)產(chan)(chan)權(quan)(quan)技術(shu)和(he)(he)產(chan)(chan)品的政策,提(ti)(ti)升中(zhong)(zhong)小企(qi)(qi)(qi)業(ye)(ye)(ye)創(chuang)造(zao)、運用(yong)、保護(hu)(hu)(hu)和(he)(he)管理知(zhi)識(shi)(shi)(shi)(shi)產(chan)(chan)權(quan)(quan)能(neng)力。優化中(zhong)(zhong)小企(qi)(qi)(qi)業(ye)(ye)(ye)知(zhi)識(shi)(shi)(shi)(shi)產(chan)(chan)權(quan)(quan)維權(quan)(quan)機制,建(jian)設(she)(she)一批知(zhi)識(shi)(shi)(shi)(shi)產(chan)(chan)權(quan)(quan)保護(hu)(hu)(hu)中(zhong)(zhong)心。構(gou)建(jian)知(zhi)識(shi)(shi)(shi)(shi)產(chan)(chan)權(quan)(quan)糾紛多元化解決(jue)機制,強(qiang)化中(zhong)(zhong)小企(qi)(qi)(qi)業(ye)(ye)(ye)知(zhi)識(shi)(shi)(shi)(shi)產(chan)(chan)權(quan)(quan)信息公共服務,推(tui)進知(zhi)識(shi)(shi)(shi)(shi)產(chan)(chan)權(quan)(quan)糾紛仲裁(cai)調解工作。提(ti)(ti)高(gao)(gao)知(zhi)識(shi)(shi)(shi)(shi)產(chan)(chan)權(quan)(quan)審查效率,減輕中(zhong)(zhong)小企(qi)(qi)(qi)業(ye)(ye)(ye)申請和(he)(he)維持知(zhi)識(shi)(shi)(shi)(shi)產(chan)(chan)權(quan)(quan)的費(fei)用(yong)負擔(dan)。

(二十(shi)三)完(wan)善中小(xiao)(xiao)企(qi)業維(wei)權救(jiu)濟制度。構(gou)建統(tong)一的(de)政務(wu)咨(zi)詢投(tou)(tou)訴(su)舉(ju)報(bao)平臺,暢通中小(xiao)(xiao)企(qi)業表達訴(su)求渠道,完(wan)善咨(zi)詢投(tou)(tou)訴(su)舉(ju)報(bao)處理(li)程(cheng)序和督辦考核(he)機(ji)制。探索建立(li)中小(xiao)(xiao)企(qi)業公益(yi)訴(su)訟制度、國際(ji)維(wei)權服(fu)務(wu)機(ji)制。鼓勵法(fa)律服(fu)務(wu)機(ji)構(gou)開展小(xiao)(xiao)微企(qi)業法(fa)律咨(zi)詢公益(yi)服(fu)務(wu)。建立(li)健全中小(xiao)(xiao)企(qi)業應急(ji)救(jiu)援(yuan)救(jiu)濟機(ji)制,幫助(zhu)中小(xiao)(xiao)企(qi)業應對自然(ran)災(zai)(zai)害、事(shi)故災(zai)(zai)難(nan)、公共衛生事(shi)件(jian)和社(she)會安全事(shi)件(jian)等不可(ke)抗力(li)事(shi)件(jian)。

七、強化促進中小企業發展組織領導制度

(二十四)強(qiang)化各級促(cu)進(jin)(jin)(jin)中(zhong)小(xiao)(xiao)(xiao)企業(ye)(ye)發(fa)展(zhan)工(gong)(gong)作(zuo)機(ji)制(zhi)。縣級以上(shang)地方人民政(zheng)府必(bi)須建立健全促(cu)進(jin)(jin)(jin)中(zhong)小(xiao)(xiao)(xiao)企業(ye)(ye)發(fa)展(zhan)領(ling)(ling)(ling)導(dao)(dao)小(xiao)(xiao)(xiao)組(zu)(zu),由政(zheng)府領(ling)(ling)(ling)導(dao)(dao)擔(dan)任領(ling)(ling)(ling)導(dao)(dao)小(xiao)(xiao)(xiao)組(zu)(zu)組(zu)(zu)長,辦公室設(she)(she)在(zai)負責中(zhong)小(xiao)(xiao)(xiao)企業(ye)(ye)促(cu)進(jin)(jin)(jin)工(gong)(gong)作(zuo)的綜(zong)合(he)管理部(bu)(bu)門,強(qiang)化促(cu)進(jin)(jin)(jin)中(zhong)小(xiao)(xiao)(xiao)企業(ye)(ye)發(fa)展(zhan)工(gong)(gong)作(zuo)隊(dui)伍建設(she)(she)。領(ling)(ling)(ling)導(dao)(dao)小(xiao)(xiao)(xiao)組(zu)(zu)要定期(qi)召開(kai)會(hui)議研究落實黨中(zhong)央、國務院(yuan)促(cu)進(jin)(jin)(jin)中(zhong)小(xiao)(xiao)(xiao)企業(ye)(ye)發(fa)展(zhan)的重(zhong)大決策(ce)部(bu)(bu)署(shu),及時向上(shang)一級領(ling)(ling)(ling)導(dao)(dao)小(xiao)(xiao)(xiao)組(zu)(zu)辦公室報(bao)告有關工(gong)(gong)作(zuo)情(qing)況。領(ling)(ling)(ling)導(dao)(dao)小(xiao)(xiao)(xiao)組(zu)(zu)各成員(yuan)單(dan)位要認(ren)真執行領(ling)(ling)(ling)導(dao)(dao)小(xiao)(xiao)(xiao)組(zu)(zu)議定事(shi)項(xiang),建立內部(bu)(bu)責任制(zhi),加強(qiang)工(gong)(gong)作(zuo)落實。

(二十五)完(wan)善(shan)中(zhong)小企(qi)業(ye)決策(ce)(ce)保障(zhang)工作機(ji)制(zhi)(zhi)。完(wan)善(shan)中(zhong)小企(qi)業(ye)政(zheng)策(ce)(ce)咨詢制(zhi)(zhi)度(du)(du),培育一批聚焦(jiao)中(zhong)小企(qi)業(ye)研究的(de)中(zhong)國特色新型智庫,建立政(zheng)策(ce)(ce)出臺前(qian)征(zheng)求中(zhong)小企(qi)業(ye)與專家意(yi)見制(zhi)(zhi)度(du)(du)和政(zheng)策(ce)(ce)實施效果評估制(zhi)(zhi)度(du)(du)。完(wan)善(shan)中(zhong)小企(qi)業(ye)政(zheng)策(ce)(ce)發(fa)布、解讀和輿情(qing)引導機(ji)制(zhi)(zhi),提高政(zheng)策(ce)(ce)知曉率(lv)、獲得感和滿意(yi)度(du)(du)。定期開(kai)展中(zhong)小企(qi)業(ye)發(fa)展環境第三方評估,并向社會公布結果。
