十七部門印發《關于健全支持中小企業發展制度的若干意見》

中(zhong)小企業(ye)是(shi)國(guo)(guo)民(min)經濟(ji)和(he)社(she)會(hui)發(fa)(fa)(fa)展(zhan)的(de)主(zhu)力軍,是(shi)建設現代(dai)化(hua)經濟(ji)體系、推動經濟(ji)高質量發(fa)(fa)(fa)展(zhan)的(de)重(zhong)要基礎(chu)(chu),是(shi)擴大就業(ye)、改善(shan)民(min)生的(de)重(zhong)要支撐,是(shi)企業(ye)家精神的(de)重(zhong)要發(fa)(fa)(fa)源地(di)。黨(dang)中(zhong)央、國(guo)(guo)務院高度(du)(du)重(zhong)視中(zhong)小企業(ye)發(fa)(fa)(fa)展(zhan),近年來出臺了(le)一(yi)系列(lie)政策(ce)措(cuo)施,有(you)關工作取得(de)積極(ji)成效(xiao),但仍存在一(yi)些突出問題,特別是(shi)一(yi)些基礎(chu)(chu)性(xing)制度(du)(du)性(xing)問題亟待解決(jue)。為深入(ru)貫徹黨(dang)的(de)十九屆四中(zhong)全會(hui)精神,堅持(chi)(chi)和(he)完善(shan)社(she)會(hui)主(zhu)義基本經濟(ji)制度(du)(du),堅持(chi)(chi)“兩(liang)個(ge)毫不動搖”,形成支持(chi)(chi)中(zhong)小企業(ye)發(fa)(fa)(fa)展(zhan)的(de)常態化(hua)、長效(xiao)化(hua)機(ji)制,促進中(zhong)小企業(ye)高質量發(fa)(fa)(fa)展(zhan),經國(guo)(guo)務院同意(yi),現就健全支持(chi)(chi)中(zhong)小企業(ye)發(fa)(fa)(fa)展(zhan)制度(du)(du),提出如下(xia)意(yi)見。

一、完善支持中小企業發展的基礎性制度

(一)健全(quan)中小(xiao)(xiao)企業(ye)(ye)(ye)法(fa)(fa)(fa)律法(fa)(fa)(fa)規(gui)體(ti)系。以《中小(xiao)(xiao)企業(ye)(ye)(ye)促進法(fa)(fa)(fa)》為基礎(chu),加快構(gou)建(jian)具有(you)中國特(te)色、支持中小(xiao)(xiao)企業(ye)(ye)(ye)發(fa)展、保護中小(xiao)(xiao)企業(ye)(ye)(ye)合法(fa)(fa)(fa)權益(yi)的(de)(de)法(fa)(fa)(fa)律法(fa)(fa)(fa)規(gui)體(ti)系。鼓勵地(di)方依法(fa)(fa)(fa)制定本地(di)促進中小(xiao)(xiao)企業(ye)(ye)(ye)發(fa)展的(de)(de)地(di)方法(fa)(fa)(fa)規(gui)。探(tan)索建(jian)立中小(xiao)(xiao)企業(ye)(ye)(ye)法(fa)(fa)(fa)律法(fa)(fa)(fa)規(gui)評估(gu)制度(du)和執行情(qing)況檢查制度(du),督促法(fa)(fa)(fa)律法(fa)(fa)(fa)規(gui)落(luo)實到位。

(二(er))堅持公(gong)平(ping)(ping)競爭制(zhi)(zhi)度(du)。全(quan)(quan)(quan)面(mian)(mian)實(shi)施市(shi)場(chang)準入負面(mian)(mian)清(qing)單制(zhi)(zhi)度(du),公(gong)正公(gong)平(ping)(ping)對待中小企業(ye),破除不(bu)合理門檻(jian)和(he)(he)限制(zhi)(zhi),實(shi)現(xian)大中小企業(ye)和(he)(he)各種所有制(zhi)(zhi)經濟權利平(ping)(ping)等、機(ji)會平(ping)(ping)等、規則(ze)平(ping)(ping)等。全(quan)(quan)(quan)面(mian)(mian)落實(shi)公(gong)平(ping)(ping)競爭審(shen)查制(zhi)(zhi)度(du),完善審(shen)查流(liu)程和(he)(he)標準,建立健(jian)全(quan)(quan)(quan)公(gong)平(ping)(ping)競爭審(shen)查投訴(su)、公(gong)示、抽查制(zhi)(zhi)度(du)。加(jia)強和(he)(he)改進(jin)反壟斷和(he)(he)反不(bu)正當競爭執法,維護市(shi)場(chang)競爭秩序。

(三(san))完(wan)善中(zhong)小(xiao)(xiao)(xiao)企(qi)(qi)業(ye)(ye)統(tong)計監(jian)(jian)測(ce)和發布制(zhi)度。健全中(zhong)小(xiao)(xiao)(xiao)企(qi)(qi)業(ye)(ye)統(tong)計監(jian)(jian)測(ce)制(zhi)度,定(ding)期發布中(zhong)小(xiao)(xiao)(xiao)企(qi)(qi)業(ye)(ye)統(tong)計數(shu)據。建立中(zhong)小(xiao)(xiao)(xiao)企(qi)(qi)業(ye)(ye)融(rong)資(zi)狀況調查(cha)統(tong)計制(zhi)度,編制(zhi)中(zhong)小(xiao)(xiao)(xiao)微企(qi)(qi)業(ye)(ye)金融(rong)條(tiao)件指數(shu)。加強中(zhong)小(xiao)(xiao)(xiao)企(qi)(qi)業(ye)(ye)結構化分析(xi),提高統(tong)計監(jian)(jian)測(ce)分析(xi)水平。探索利用大數(shu)據等手(shou)段開展中(zhong)小(xiao)(xiao)(xiao)企(qi)(qi)業(ye)(ye)運行監(jian)(jian)測(ce)分析(xi)。完(wan)善《中(zhong)小(xiao)(xiao)(xiao)企(qi)(qi)業(ye)(ye)主要統(tong)計數(shu)據》手(shou)冊,研(yan)究(jiu)編制(zhi)中(zhong)小(xiao)(xiao)(xiao)企(qi)(qi)業(ye)(ye)發展指數(shu)。適時(shi)修(xiu)訂中(zhong)小(xiao)(xiao)(xiao)企(qi)(qi)業(ye)(ye)劃型標(biao)準。

(四)健全(quan)(quan)中小(xiao)(xiao)(xiao)企業(ye)信(xin)(xin)用(yong)(yong)(yong)制(zhi)度。堅(jian)持“政府+市場”的模(mo)式(shi),建立(li)健全(quan)(quan)中小(xiao)(xiao)(xiao)企業(ye)信(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)息(xi)(xi)歸(gui)集、共(gong)享、查(cha)詢機制(zhi),依托全(quan)(quan)國(guo)信(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)息(xi)(xi)共(gong)享平(ping)臺(tai),及時整合共(gong)享各類涉(she)(she)企公(gong)共(gong)服務數(shu)據。建立(li)健全(quan)(quan)中小(xiao)(xiao)(xiao)企業(ye)信(xin)(xin)用(yong)(yong)(yong)評價體系(xi),完(wan)善金(jin)融信(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)息(xi)(xi)基礎數(shu)據庫,創(chuang)新小(xiao)(xiao)(xiao)微企業(ye)征信(xin)(xin)產品,高效對(dui)接金(jin)融服務。研究出(chu)臺(tai)有(you)關法律法規,規范中小(xiao)(xiao)(xiao)企業(ye)信(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)息(xi)(xi)采(cai)集、公(gong)示(shi)查(cha)詢和(he)信(xin)(xin)用(yong)(yong)(yong)監管等。發揮國(guo)家企業(ye)信(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)息(xi)(xi)公(gong)示(shi)系(xi)統的基礎作(zuo)用(yong)(yong)(yong),將涉(she)(she)企信(xin)(xin)息(xi)(xi)記于企業(ye)名下并依法公(gong)示(shi)。

(五(wu))完善公正監(jian)管(guan)制(zhi)度。減少監(jian)管(guan)事(shi)項,簡化辦事(shi)流程(cheng),推(tui)廣全程(cheng)網上辦、引導幫(bang)辦,全面推(tui)行信用監(jian)管(guan)和“互聯(lian)網+監(jian)管(guan)”改革。推(tui)進分級分類(lei)、跨部門聯(lian)合監(jian)管(guan),加強和規范(fan)事(shi)中(zhong)事(shi)后監(jian)管(guan),落實和完善包(bao)容審慎監(jian)管(guan),避免對中(zhong)小企業(ye)采取簡單粗暴處理措施(shi),對“一刀切”行為嚴(yan)肅(su)查(cha)處。

       二、堅持和完善中小企業財稅支持制度

(六)健全精準有效的(de)財政(zheng)支(zhi)持制度(du)。中央財政(zheng)設(she)立(li)(li)中小企(qi)業(ye)科(ke)目(mu),縣(xian)級以(yi)上財政(zheng)根(gen)據實際(ji)情況安排中小企(qi)業(ye)發展(zhan)(zhan)專(zhuan)項資金。建立(li)(li)國家(jia)中小企(qi)業(ye)發展(zhan)(zhan)基(ji)金公司制母基(ji)金,健全基(ji)金管理(li)制度(du),完(wan)善(shan)基(ji)金市(shi)場化運(yun)作(zuo)機(ji)制,引導有條件的(de)地(di)方政(zheng)府(fu)設(she)立(li)(li)中小企(qi)業(ye)發展(zhan)(zhan)基(ji)金。完(wan)善(shan)專(zhuan)項資金管理(li)辦法,加(jia)強(qiang)資金績效評價。

(七)建立減輕(qing)小微企(qi)(qi)(qi)(qi)業(ye)稅(shui)(shui)費(fei)(fei)(fei)負(fu)擔(dan)長效機制。實(shi)(shi)行有(you)利于小微企(qi)(qi)(qi)(qi)業(ye)發展(zhan)的稅(shui)(shui)收(shou)政(zheng)(zheng)策,依法對符(fu)合條件的小微企(qi)(qi)(qi)(qi)業(ye)按照規定實(shi)(shi)行緩征(zheng)、減征(zheng)、免征(zheng)企(qi)(qi)(qi)(qi)業(ye)所(suo)得稅(shui)(shui)、增值稅(shui)(shui)等措施,簡化稅(shui)(shui)收(shou)征(zheng)管程(cheng)序(xu);對小微企(qi)(qi)(qi)(qi)業(ye)行政(zheng)(zheng)事業(ye)性收(shou)費(fei)(fei)(fei)實(shi)(shi)行減免等優惠政(zheng)(zheng)策,減輕(qing)小微企(qi)(qi)(qi)(qi)業(ye)稅(shui)(shui)費(fei)(fei)(fei)負(fu)擔(dan)。落實(shi)(shi)好涉(she)企(qi)(qi)(qi)(qi)收(shou)費(fei)(fei)(fei)目(mu)錄(lu)清單制度(du),加強涉(she)企(qi)(qi)(qi)(qi)收(shou)費(fei)(fei)(fei)監督檢查,清理規范涉(she)企(qi)(qi)(qi)(qi)收(shou)費(fei)(fei)(fei)。

(八)強化政府采(cai)購(gou)(gou)支持(chi)中(zhong)小企業(ye)政策機制。修訂《政府采(cai)購(gou)(gou)促進(jin)中(zhong)小企業(ye)發展(zhan)暫行辦法(fa)》,完善預留(liu)采(cai)購(gou)(gou)份額(e)、價(jia)格(ge)評審優惠等(deng)措施,提高中(zhong)小企業(ye)在(zai)政府采(cai)購(gou)(gou)中(zhong)的份額(e)。向中(zhong)小企業(ye)預留(liu)采(cai)購(gou)(gou)份額(e)應(ying)占本(ben)部門(men)年(nian)度(du)政府采(cai)購(gou)(gou)項目預算總額(e)的30%以上;其(qi)中(zhong),預留(liu)給小微企業(ye)的比例不低于60%。

三、堅持和完善中小企業融資促進制度

(九)優化貨幣(bi)信貸(dai)傳(chuan)導(dao)(dao)機(ji)制。綜合(he)運用支小再貸(dai)款(kuan)、再貼(tie)現、差(cha)別存款(kuan)準備金率(lv)(lv)(lv)(lv)等貨幣(bi)政策(ce)工具,引導(dao)(dao)商業(ye)銀行增加(jia)小微(wei)企(qi)業(ye)信貸(dai)投放。進(jin)一步疏通利(li)(li)(li)(li)率(lv)(lv)(lv)(lv)傳(chuan)導(dao)(dao)渠道(dao),確(que)保(bao)貸(dai)款(kuan)市場報(bao)價利(li)(li)(li)(li)率(lv)(lv)(lv)(lv)(LPR)有效傳(chuan)導(dao)(dao)至貸(dai)款(kuan)利(li)(li)(li)(li)率(lv)(lv)(lv)(lv)。建立差(cha)異化小微(wei)企(qi)業(ye)利(li)(li)(li)(li)率(lv)(lv)(lv)(lv)定價機(ji)制,促進(jin)信貸(dai)利(li)(li)(li)(li)率(lv)(lv)(lv)(lv)和費(fei)用公(gong)開透明,保(bao)持小微(wei)企(qi)業(ye)貸(dai)款(kuan)利(li)(li)(li)(li)率(lv)(lv)(lv)(lv)定價合(he)理水(shui)平。

(十)健(jian)全多(duo)層次小(xiao)微企(qi)業金(jin)(jin)融(rong)(rong)服務(wu)體(ti)系。推進(jin)普惠金(jin)(jin)融(rong)(rong)體(ti)系建設(she),深化大中型銀行普惠金(jin)(jin)融(rong)(rong)事業部(bu)改革,推動(dong)(dong)中小(xiao)銀行、非存款(kuan)類金(jin)(jin)融(rong)(rong)機(ji)構和互聯網金(jin)(jin)融(rong)(rong)有序健(jian)康發展。鼓勵金(jin)(jin)融(rong)(rong)機(ji)構創新產品和服務(wu),發展便利續貸(dai)(dai)業務(wu)和信用貸(dai)(dai)款(kuan),增加(jia)(jia)小(xiao)微企(qi)業首貸(dai)(dai)、中長期(qi)貸(dai)(dai)款(kuan)、知(zhi)識產權質押貸(dai)(dai)款(kuan)等,開(kai)展供應鏈金(jin)(jin)融(rong)(rong)、應收(shou)賬款(kuan)融(rong)(rong)資,加(jia)(jia)強銀稅互動(dong)(dong)。推動(dong)(dong)金(jin)(jin)融(rong)(rong)科技賦(fu)能金(jin)(jin)融(rong)(rong)機(ji)構服務(wu)中小(xiao)企(qi)業。研究(jiu)出臺《非存款(kuan)類放貸(dai)(dai)組織條例》。加(jia)(jia)快(kuai)推進(jin)小(xiao)額金(jin)(jin)融(rong)(rong)糾紛快(kuai)速解決(jue)等機(ji)制(zhi)建設(she)。完(wan)善規范銀行業涉(she)企(qi)服務(wu)收(shou)費監管法(fa)規制(zhi)度,降低小(xiao)微企(qi)業綜(zong)合(he)性融(rong)(rong)資成本。

(十(shi)一)強(qiang)化小(xiao)微企業(ye)(ye)(ye)金(jin)(jin)融(rong)差(cha)異化監(jian)管激(ji)勵(li)機(ji)(ji)制。健全商(shang)業(ye)(ye)(ye)銀(yin)行(xing)小(xiao)微企業(ye)(ye)(ye)金(jin)(jin)融(rong)服務(wu)(wu)監(jian)管長效機(ji)(ji)制,出(chu)臺《商(shang)業(ye)(ye)(ye)銀(yin)行(xing)小(xiao)微企業(ye)(ye)(ye)金(jin)(jin)融(rong)服務(wu)(wu)監(jian)管評價辦法》。修訂《金(jin)(jin)融(rong)企業(ye)(ye)(ye)績效評價辦法》。將商(shang)業(ye)(ye)(ye)銀(yin)行(xing)小(xiao)微企業(ye)(ye)(ye)服務(wu)(wu)情(qing)況與資(zi)(zi)本補充、金(jin)(jin)融(rong)債發行(xing)、宏觀審慎(shen)評估(MPA)考核(he)、金(jin)(jin)融(rong)機(ji)(ji)構總部(bu)(bu)相關(guan)負責人考核(he)及提任掛鉤。引導銀(yin)行(xing)業(ye)(ye)(ye)金(jin)(jin)融(rong)機(ji)(ji)構探(tan)索建立(li)授信(xin)盡職免責負面清單制度(du)。督促商(shang)業(ye)(ye)(ye)銀(yin)行(xing)優化內部(bu)(bu)信(xin)貸資(zi)(zi)源配置和考核(he)激(ji)勵(li)機(ji)(ji)制,單列小(xiao)微企業(ye)(ye)(ye)信(xin)貸計劃,改(gai)進貸款(kuan)服務(wu)(wu)方式。

(十(shi)二)完(wan)(wan)善中(zhong)小企(qi)(qi)業(ye)(ye)直接融(rong)(rong)資(zi)(zi)支持(chi)(chi)制(zhi)度(du)。大(da)(da)力(li)培(pei)育(yu)創(chuang)業(ye)(ye)投(tou)資(zi)(zi)市(shi)(shi)場,完(wan)(wan)善創(chuang)業(ye)(ye)投(tou)資(zi)(zi)激(ji)勵(li)和(he)退出(chu)機(ji)制(zhi),引導天使投(tou)資(zi)(zi)人(ren)群體(ti)、私募股(gu)權、創(chuang)業(ye)(ye)投(tou)資(zi)(zi)等擴(kuo)大(da)(da)中(zhong)小企(qi)(qi)業(ye)(ye)股(gu)權融(rong)(rong)資(zi)(zi),更多(duo)地投(tou)長、投(tou)早、投(tou)小、投(tou)創(chuang)新(xin)。穩步(bu)推(tui)進以信(xin)息(xi)披露為(wei)核心的(de)注冊(ce)制(zhi)改革,支持(chi)(chi)更多(duo)優(you)質中(zhong)小企(qi)(qi)業(ye)(ye)登陸資(zi)(zi)yabo官(guan)网場。鼓勵(li)中(zhong)小企(qi)(qi)業(ye)(ye)通過并購重組對(dui)接資(zi)(zi)yabo官(guan)网場。穩步(bu)推(tui)進新(xin)三板改革,健全掛(gua)牌公司轉板上(shang)市(shi)(shi)機(ji)制(zhi)。完(wan)(wan)善中(zhong)小企(qi)(qi)業(ye)(ye)上(shang)市(shi)(shi)培(pei)育(yu)機(ji)制(zhi),鼓勵(li)地方加大(da)(da)對(dui)小升(sheng)規(gui)、規(gui)改股(gu)、股(gu)上(shang)市(shi)(shi)企(qi)(qi)業(ye)(ye)的(de)支持(chi)(chi)。加大(da)(da)優(you)質中(zhong)小企(qi)(qi)業(ye)(ye)債券融(rong)(rong)資(zi)(zi),通過市(shi)(shi)場化機(ji)制(zhi)開發(fa)更多(duo)適合中(zhong)小企(qi)(qi)業(ye)(ye)的(de)債券品種,完(wan)(wan)善中(zhong)小企(qi)(qi)業(ye)(ye)債券融(rong)(rong)資(zi)(zi)增信(xin)機(ji)制(zhi),擴(kuo)大(da)(da)債券融(rong)(rong)資(zi)(zi)規(gui)模。

(十三)完(wan)善(shan)中小(xiao)(xiao)企業(ye)融資(zi)擔(dan)保(bao)(bao)體系。健全政府(fu)性(xing)融資(zi)擔(dan)保(bao)(bao)體系,發揮國家融資(zi)擔(dan)保(bao)(bao)基金(jin)(jin)作用,實施小(xiao)(xiao)微企業(ye)融資(zi)擔(dan)保(bao)(bao)降(jiang)費獎補政策,完(wan)善(shan)風(feng)(feng)險(xian)(xian)補償機(ji)制和(he)(he)績效考核激勵(li)機(ji)制,引導各級政府(fu)性(xing)融資(zi)擔(dan)保(bao)(bao)機(ji)構擴大小(xiao)(xiao)微企業(ye)融資(zi)擔(dan)保(bao)(bao)業(ye)務規模、降(jiang)低擔(dan)保(bao)(bao)費率(lv)水平。鼓(gu)勵(li)銀行業(ye)金(jin)(jin)融機(ji)構加大與(yu)政府(fu)性(xing)融資(zi)擔(dan)保(bao)(bao)機(ji)構合作,合理確定風(feng)(feng)險(xian)(xian)分擔(dan)比例和(he)(he)擔(dan)保(bao)(bao)貸款風(feng)(feng)險(xian)(xian)權重,落實金(jin)(jin)融機(ji)構和(he)(he)融資(zi)擔(dan)保(bao)(bao)機(ji)構盡職免(mian)責(ze)制度,提高小(xiao)(xiao)微企業(ye)融資(zi)可獲得性(xing)。推動建(jian)立統一(yi)的動產和(he)(he)權利擔(dan)保(bao)(bao)登記公示系統。

四、建立和健全中小企業創新發展制度

(十四)完善(shan)創(chuang)(chuang)業(ye)(ye)扶持制(zhi)度。改善(shan)創(chuang)(chuang)業(ye)(ye)環境(jing),廣泛培(pei)育(yu)創(chuang)(chuang)業(ye)(ye)主體。完善(shan)創(chuang)(chuang)業(ye)(ye)載體建設,健(jian)全扶持與評(ping)價機制(zhi),為小微企(qi)業(ye)(ye)創(chuang)(chuang)業(ye)(ye)提供低成本、便利化、高質量服(fu)務。鼓勵大(da)企(qi)業(ye)(ye)發揮技(ji)術優勢、人才優勢和市場優勢,為創(chuang)(chuang)業(ye)(ye)活動提供支(zhi)撐。鼓勵服(fu)務機構提供創(chuang)(chuang)業(ye)(ye)相關(guan)規范(fan)化、專業(ye)(ye)化服(fu)務。

(十五(wu))完善(shan)(shan)中(zhong)(zhong)小企(qi)業(ye)(ye)(ye)(ye)(ye)(ye)創新(xin)(xin)(xin)支持(chi)制(zhi)度(du)。創新(xin)(xin)(xin)中(zhong)(zhong)小企(qi)業(ye)(ye)(ye)(ye)(ye)(ye)產學研深度(du)融合機制(zhi),促進大(da)(da)(da)中(zhong)(zhong)小企(qi)業(ye)(ye)(ye)(ye)(ye)(ye)聯合參與(yu)重大(da)(da)(da)科(ke)(ke)(ke)技(ji)項目,推動高校、科(ke)(ke)(ke)研院所和(he)(he)大(da)(da)(da)企(qi)業(ye)(ye)(ye)(ye)(ye)(ye)科(ke)(ke)(ke)研儀器、實驗設施(shi)、中(zhong)(zhong)試(shi)(shi)小試(shi)(shi)基地等創新(xin)(xin)(xin)資源向中(zhong)(zhong)小企(qi)業(ye)(ye)(ye)(ye)(ye)(ye)開放。調整完善(shan)(shan)科(ke)(ke)(ke)技(ji)計劃(hua)立項、任(ren)務部署和(he)(he)組織(zhi)管理方式,大(da)(da)(da)幅(fu)提高中(zhong)(zhong)小企(qi)業(ye)(ye)(ye)(ye)(ye)(ye)承擔研發(fa)任(ren)務比例,加(jia)大(da)(da)(da)對中(zhong)(zhong)小企(qi)業(ye)(ye)(ye)(ye)(ye)(ye)研發(fa)活動的直接支持(chi)。完善(shan)(shan)專業(ye)(ye)(ye)(ye)(ye)(ye)化(hua)市(shi)場化(hua)創新(xin)(xin)(xin)服(fu)務體系(xi),完善(shan)(shan)國家技(ji)術(shu)創新(xin)(xin)(xin)中(zhong)(zhong)心(xin)(xin)、制(zhi)造業(ye)(ye)(ye)(ye)(ye)(ye)創新(xin)(xin)(xin)中(zhong)(zhong)心(xin)(xin)等支持(chi)中(zhong)(zhong)小企(qi)業(ye)(ye)(ye)(ye)(ye)(ye)創新(xin)(xin)(xin)的機制(zhi),提升小微企(qi)業(ye)(ye)(ye)(ye)(ye)(ye)創業(ye)(ye)(ye)(ye)(ye)(ye)創新(xin)(xin)(xin)示范基地、科(ke)(ke)(ke)技(ji)企(qi)業(ye)(ye)(ye)(ye)(ye)(ye)孵化(hua)器、專業(ye)(ye)(ye)(ye)(ye)(ye)化(hua)眾創空(kong)間、大(da)(da)(da)學科(ke)(ke)(ke)技(ji)園等扶(fu)持(chi)中(zhong)(zhong)小企(qi)業(ye)(ye)(ye)(ye)(ye)(ye)創新(xin)(xin)(xin)的能力(li)與(yu)水平(ping)。完善(shan)(shan)中(zhong)(zhong)小企(qi)業(ye)(ye)(ye)(ye)(ye)(ye)創新(xin)(xin)(xin)人才引進和(he)(he)培育制(zhi)度(du),優(you)化(hua)人才激(ji)勵(li)和(he)(he)權(quan)益保障(zhang)機制(zhi)。以(yi)包容審慎(shen)的態度(du),鼓(gu)勵(li)中(zhong)(zhong)小企(qi)業(ye)(ye)(ye)(ye)(ye)(ye)技(ji)術(shu)創新(xin)(xin)(xin)、產品創新(xin)(xin)(xin)、模式創新(xin)(xin)(xin)。

(十六(liu))完善(shan)支(zhi)持中小(xiao)(xiao)(xiao)企(qi)業(ye)(ye)(ye)(ye)(ye)“專精(jing)(jing)特新(xin)(xin)”發(fa)展機(ji)制。健全“專精(jing)(jing)特新(xin)(xin)”中小(xiao)(xiao)(xiao)企(qi)業(ye)(ye)(ye)(ye)(ye)、專精(jing)(jing)特新(xin)(xin)“小(xiao)(xiao)(xiao)巨人”企(qi)業(ye)(ye)(ye)(ye)(ye)和(he)制造業(ye)(ye)(ye)(ye)(ye)單項冠軍企(qi)業(ye)(ye)(ye)(ye)(ye)梯度培(pei)育(yu)體系(xi)、標準(zhun)體系(xi)和(he)評價機(ji)制,引導中小(xiao)(xiao)(xiao)企(qi)業(ye)(ye)(ye)(ye)(ye)走“專精(jing)(jing)特新(xin)(xin)”之路(lu)。完善(shan)大中小(xiao)(xiao)(xiao)企(qi)業(ye)(ye)(ye)(ye)(ye)和(he)各(ge)類主體協同創(chuang)新(xin)(xin)和(he)融通發(fa)展制度,發(fa)揮大企(qi)業(ye)(ye)(ye)(ye)(ye)引領支(zhi)撐作用,提高(gao)中小(xiao)(xiao)(xiao)企(qi)業(ye)(ye)(ye)(ye)(ye)專業(ye)(ye)(ye)(ye)(ye)化能力和(he)水平。

(十七)構(gou)建以信(xin)息技(ji)(ji)術(shu)(shu)(shu)(shu)(shu)為主(zhu)的新(xin)技(ji)(ji)術(shu)(shu)(shu)(shu)(shu)應(ying)(ying)(ying)用機(ji)制。支(zhi)(zhi)持(chi)中(zhong)(zhong)小企業(ye)(ye)發展應(ying)(ying)(ying)用5G、工(gong)業(ye)(ye)互(hu)聯網(wang)、大數據、云計算、人工(gong)智(zhi)能(neng)(neng)、區塊鏈等(deng)新(xin)一(yi)代信(xin)息技(ji)(ji)術(shu)(shu)(shu)(shu)(shu)以及新(xin)材料技(ji)(ji)術(shu)(shu)(shu)(shu)(shu)、智(zhi)能(neng)(neng)綠色(se)服務(wu)制造技(ji)(ji)術(shu)(shu)(shu)(shu)(shu)、先(xian)進高(gao)效生物技(ji)(ji)術(shu)(shu)(shu)(shu)(shu)等(deng),完善(shan)支(zhi)(zhi)持(chi)中(zhong)(zhong)小企業(ye)(ye)應(ying)(ying)(ying)用新(xin)技(ji)(ji)術(shu)(shu)(shu)(shu)(shu)的工(gong)作機(ji)制,提升(sheng)中(zhong)(zhong)小企業(ye)(ye)數字化、網(wang)絡化、智(zhi)能(neng)(neng)化、綠色(se)化水(shui)平。支(zhi)(zhi)持(chi)產業(ye)(ye)園(yuan)區、產業(ye)(ye)集群提高(gao)基礎設(she)施支(zhi)(zhi)撐(cheng)能(neng)(neng)力,建立中(zhong)(zhong)小企業(ye)(ye)新(xin)技(ji)(ji)術(shu)(shu)(shu)(shu)(shu)公共服務(wu)平臺,完善(shan)新(xin)技(ji)(ji)術(shu)(shu)(shu)(shu)(shu)推廣機(ji)制,提高(gao)新(xin)技(ji)(ji)術(shu)(shu)(shu)(shu)(shu)在(zai)園(yuan)區和(he)產業(ye)(ye)鏈上的整體應(ying)(ying)(ying)用水(shui)平。

五、完善和優化中小企業服務體系

(十(shi)八)完善中(zhong)(zhong)小企(qi)業(ye)(ye)服(fu)(fu)務(wu)(wu)(wu)體(ti)系。健(jian)全政府公(gong)共服(fu)(fu)務(wu)(wu)(wu)、市場化(hua)(hua)服(fu)(fu)務(wu)(wu)(wu)、社(she)會化(hua)(hua)公(gong)益服(fu)(fu)務(wu)(wu)(wu)相結合的(de)中(zhong)(zhong)小企(qi)業(ye)(ye)服(fu)(fu)務(wu)(wu)(wu)體(ti)系,完善服(fu)(fu)務(wu)(wu)(wu)機構良性(xing)發(fa)展(zhan)機制(zhi)和(he)公(gong)共服(fu)(fu)務(wu)(wu)(wu)平(ping)臺(tai)(tai)梯度培育(yu)、協同服(fu)(fu)務(wu)(wu)(wu)和(he)評(ping)價激(ji)勵機制(zhi)。探索建(jian)立(li)全國中(zhong)(zhong)小企(qi)業(ye)(ye)公(gong)共服(fu)(fu)務(wu)(wu)(wu)一(yi)體(ti)化(hua)(hua)平(ping)臺(tai)(tai)。發(fa)展(zhan)中(zhong)(zhong)小企(qi)業(ye)(ye)服(fu)(fu)務(wu)(wu)(wu)產業(ye)(ye),引(yin)導服(fu)(fu)務(wu)(wu)(wu)機構提(ti)供(gong)規范化(hua)(hua)、精細化(hua)(hua)、個性(xing)化(hua)(hua)服(fu)(fu)務(wu)(wu)(wu),引(yin)導大企(qi)業(ye)(ye)結合產業(ye)(ye)鏈(lian)、供(gong)應鏈(lian)、價值鏈(lian)、創新鏈(lian)為中(zhong)(zhong)小企(qi)業(ye)(ye)提(ti)供(gong)配套服(fu)(fu)務(wu)(wu)(wu)。鼓勵各類社(she)會組織為企(qi)業(ye)(ye)提(ti)供(gong)公(gong)益性(xing)服(fu)(fu)務(wu)(wu)(wu),探索建(jian)立(li)志愿(yuan)服(fu)(fu)務(wu)(wu)(wu)機制(zhi)。

(十九)健(jian)(jian)全(quan)促進中(zhong)(zhong)小(xiao)企業管(guan)理提(ti)升機(ji)制(zhi)。完善中(zhong)(zhong)小(xiao)企業培(pei)訓制(zhi)度,構建具有時代特點的課程、教材、師(shi)資(zi)和組織體(ti)(ti)系,建設慕課平臺,構建多領域、多層次、線上線下相(xiang)結合(he)的中(zhong)(zhong)小(xiao)企業培(pei)訓體(ti)(ti)系。健(jian)(jian)全(quan)技能(neng)人才培(pei)養(yang)、使用(yong)、評價、激勵制(zhi)度,加(jia)快培(pei)養(yang)高素(su)質技能(neng)人才,弘揚(yang)“工(gong)匠(jiang)精神”。健(jian)(jian)全(quan)中(zhong)(zhong)小(xiao)企業品牌培(pei)育機(ji)制(zhi)。實施小(xiao)微企業質量管(guan)理提(ti)升行動。完善中(zhong)(zhong)小(xiao)企業管(guan)理咨詢(xun)服(fu)務機(ji)制(zhi)。

(二十)夯實中(zhong)(zhong)小企(qi)業(ye)國(guo)際交流合(he)作機(ji)(ji)制。深(shen)化雙(shuang)多邊中(zhong)(zhong)小企(qi)業(ye)合(he)作機(ji)(ji)制,促(cu)進中(zhong)(zhong)小企(qi)業(ye)國(guo)際交流合(he)作。探索建設中(zhong)(zhong)小企(qi)業(ye)海外(wai)服務(wu)體系(xi),夯實中(zhong)(zhong)小企(qi)業(ye)國(guo)際化發展(zhan)服務(wu)機(ji)(ji)制,在(zai)國(guo)際商務(wu)法務(wu)咨詢、知識產權(quan)保(bao)護(hu)、技(ji)術(shu)性貿(mao)易措施、質量認證等方(fang)面為中(zhong)(zhong)小企(qi)業(ye)提(ti)供幫助。支(zhi)持(chi)有條件的地方(fang)建設中(zhong)(zhong)外(wai)中(zhong)(zhong)小企(qi)業(ye)合(he)作區(qu),完善(shan)評價(jia)激勵機(ji)(ji)制。推進關稅保(bao)證保(bao)險改革。鼓勵跨境(jing)電商等新業(ye)態發展(zhan),探索建立(li)B2B出口監管(guan)制度(du),支(zhi)持(chi)跨境(jing)電商優進優出。

六、建立和健全中小企業合法權益保護制度

(二(er)十一(yi))構建保護中小企(qi)(qi)(qi)業(ye)及企(qi)(qi)(qi)業(ye)家合法財(cai)產(chan)(chan)權(quan)制度。堅(jian)決保護中小企(qi)(qi)(qi)業(ye)及企(qi)(qi)(qi)業(ye)家合法財(cai)產(chan)(chan)權(quan),依(yi)法懲治侵犯(fan)(fan)中小企(qi)(qi)(qi)業(ye)投資者、管理者和(he)從(cong)業(ye)人(ren)員(yuan)(yuan)合法權(quan)益的違法犯(fan)(fan)罪行(xing)為。嚴格按照法定程序采取查封(feng)、扣押、凍結(jie)等措施,依(yi)法嚴格區分違法所得、其他涉(she)案財(cai)產(chan)(chan)與(yu)合法財(cai)產(chan)(chan),嚴格區分企(qi)(qi)(qi)業(ye)法人(ren)財(cai)產(chan)(chan)與(yu)股東(dong)個(ge)人(ren)財(cai)產(chan)(chan),嚴格區分涉(she)案人(ren)員(yuan)(yuan)個(ge)人(ren)財(cai)產(chan)(chan)與(yu)家庭成員(yuan)(yuan)財(cai)產(chan)(chan)。建立涉(she)政府(fu)產(chan)(chan)權(quan)糾紛治理長效機制。出臺并落實《保障(zhang)中小企(qi)(qi)(qi)業(ye)款項(xiang)支付條例(li)》,從(cong)源(yuan)頭遏(e)制拖欠(qian)問題。

(二(er)十二(er))健全中(zhong)(zhong)(zhong)小(xiao)企(qi)業(ye)知(zhi)(zhi)識(shi)(shi)(shi)(shi)(shi)產(chan)(chan)(chan)權(quan)(quan)(quan)保護(hu)(hu)制(zhi)(zhi)度(du)。完善知(zhi)(zhi)識(shi)(shi)(shi)(shi)(shi)產(chan)(chan)(chan)權(quan)(quan)(quan)保護(hu)(hu)法律法規和(he)(he)(he)政策(ce),建(jian)(jian)立健全懲罰性賠償制(zhi)(zhi)度(du),提(ti)高法定(ding)賠償額。實(shi)施中(zhong)(zhong)(zhong)小(xiao)企(qi)業(ye)知(zhi)(zhi)識(shi)(shi)(shi)(shi)(shi)產(chan)(chan)(chan)權(quan)(quan)(quan)戰略推(tui)進工(gong)(gong)程,加強(qiang)(qiang)知(zhi)(zhi)識(shi)(shi)(shi)(shi)(shi)產(chan)(chan)(chan)權(quan)(quan)(quan)服務業(ye)集聚發展區建(jian)(jian)設,強(qiang)(qiang)化專利導航工(gong)(gong)作機(ji)(ji)制(zhi)(zhi),完善支持中(zhong)(zhong)(zhong)小(xiao)企(qi)業(ye)開發自主知(zhi)(zhi)識(shi)(shi)(shi)(shi)(shi)產(chan)(chan)(chan)權(quan)(quan)(quan)技(ji)術(shu)和(he)(he)(he)產(chan)(chan)(chan)品的政策(ce),提(ti)升中(zhong)(zhong)(zhong)小(xiao)企(qi)業(ye)創造、運用(yong)、保護(hu)(hu)和(he)(he)(he)管(guan)理知(zhi)(zhi)識(shi)(shi)(shi)(shi)(shi)產(chan)(chan)(chan)權(quan)(quan)(quan)能力(li)。優化中(zhong)(zhong)(zhong)小(xiao)企(qi)業(ye)知(zhi)(zhi)識(shi)(shi)(shi)(shi)(shi)產(chan)(chan)(chan)權(quan)(quan)(quan)維權(quan)(quan)(quan)機(ji)(ji)制(zhi)(zhi),建(jian)(jian)設一批知(zhi)(zhi)識(shi)(shi)(shi)(shi)(shi)產(chan)(chan)(chan)權(quan)(quan)(quan)保護(hu)(hu)中(zhong)(zhong)(zhong)心。構(gou)建(jian)(jian)知(zhi)(zhi)識(shi)(shi)(shi)(shi)(shi)產(chan)(chan)(chan)權(quan)(quan)(quan)糾(jiu)紛多元化解決機(ji)(ji)制(zhi)(zhi),強(qiang)(qiang)化中(zhong)(zhong)(zhong)小(xiao)企(qi)業(ye)知(zhi)(zhi)識(shi)(shi)(shi)(shi)(shi)產(chan)(chan)(chan)權(quan)(quan)(quan)信(xin)息公共(gong)服務,推(tui)進知(zhi)(zhi)識(shi)(shi)(shi)(shi)(shi)產(chan)(chan)(chan)權(quan)(quan)(quan)糾(jiu)紛仲裁調解工(gong)(gong)作。提(ti)高知(zhi)(zhi)識(shi)(shi)(shi)(shi)(shi)產(chan)(chan)(chan)權(quan)(quan)(quan)審查(cha)效率,減輕中(zhong)(zhong)(zhong)小(xiao)企(qi)業(ye)申請(qing)和(he)(he)(he)維持知(zhi)(zhi)識(shi)(shi)(shi)(shi)(shi)產(chan)(chan)(chan)權(quan)(quan)(quan)的費用(yong)負擔。

(二(er)十(shi)三)完善中小(xiao)企(qi)(qi)業(ye)維權救濟制(zhi)(zhi)度。構建統(tong)一(yi)的政(zheng)務咨(zi)詢投訴(su)舉報平臺,暢通中小(xiao)企(qi)(qi)業(ye)表達訴(su)求(qiu)渠道,完善咨(zi)詢投訴(su)舉報處理程序(xu)和督辦考核(he)機制(zhi)(zhi)。探索建立中小(xiao)企(qi)(qi)業(ye)公益(yi)訴(su)訟制(zhi)(zhi)度、國際維權服(fu)(fu)務機制(zhi)(zhi)。鼓(gu)勵法(fa)(fa)律服(fu)(fu)務機構開(kai)展小(xiao)微企(qi)(qi)業(ye)法(fa)(fa)律咨(zi)詢公益(yi)服(fu)(fu)務。建立健全(quan)中小(xiao)企(qi)(qi)業(ye)應急救援(yuan)救濟機制(zhi)(zhi),幫助中小(xiao)企(qi)(qi)業(ye)應對(dui)自然(ran)災害、事故災難、公共衛生事件(jian)和社會安全(quan)事件(jian)等不可抗力事件(jian)。

七、強化促進中小企業發展組織領導制度

(二十(shi)四)強化(hua)(hua)各級(ji)促(cu)進(jin)中(zhong)(zhong)小企(qi)業(ye)發(fa)展工(gong)(gong)作機制。縣級(ji)以上地方人民政(zheng)府(fu)必須(xu)建(jian)立健全促(cu)進(jin)中(zhong)(zhong)小企(qi)業(ye)發(fa)展領(ling)(ling)(ling)導(dao)小組(zu),由(you)政(zheng)府(fu)領(ling)(ling)(ling)導(dao)擔任(ren)領(ling)(ling)(ling)導(dao)小組(zu)組(zu)長,辦公室設在負責(ze)中(zhong)(zhong)小企(qi)業(ye)促(cu)進(jin)工(gong)(gong)作的(de)綜合(he)管理部門,強化(hua)(hua)促(cu)進(jin)中(zhong)(zhong)小企(qi)業(ye)發(fa)展工(gong)(gong)作隊伍建(jian)設。領(ling)(ling)(ling)導(dao)小組(zu)要(yao)(yao)定期(qi)召開會議(yi)研究落實(shi)黨中(zhong)(zhong)央、國(guo)務院(yuan)促(cu)進(jin)中(zhong)(zhong)小企(qi)業(ye)發(fa)展的(de)重大決策部署,及時(shi)向上一(yi)級(ji)領(ling)(ling)(ling)導(dao)小組(zu)辦公室報告有關工(gong)(gong)作情況。領(ling)(ling)(ling)導(dao)小組(zu)各成員單位要(yao)(yao)認真執(zhi)行(xing)領(ling)(ling)(ling)導(dao)小組(zu)議(yi)定事項,建(jian)立內部責(ze)任(ren)制,加強工(gong)(gong)作落實(shi)。

(二十五(wu))完善中(zhong)(zhong)(zhong)小(xiao)企業決(jue)策(ce)(ce)保障工作機(ji)制(zhi)(zhi)。完善中(zhong)(zhong)(zhong)小(xiao)企業政策(ce)(ce)咨詢制(zhi)(zhi)度(du),培育一批聚(ju)焦中(zhong)(zhong)(zhong)小(xiao)企業研究的(de)中(zhong)(zhong)(zhong)國特色新型智庫,建立政策(ce)(ce)出臺前(qian)征(zheng)求中(zhong)(zhong)(zhong)小(xiao)企業與專家意見制(zhi)(zhi)度(du)和政策(ce)(ce)實(shi)施效果(guo)評估制(zhi)(zhi)度(du)。完善中(zhong)(zhong)(zhong)小(xiao)企業政策(ce)(ce)發布(bu)、解(jie)讀(du)和輿(yu)情引導機(ji)制(zhi)(zhi),提(ti)高政策(ce)(ce)知曉率、獲得感和滿意度(du)。定期開展中(zhong)(zhong)(zhong)小(xiao)企業發展環境第三方評估,并(bing)向社會公布(bu)結果(guo)。
